The Petite Club Terms of Service
The terms of service contained in this agreement (the “Petite Club Terms of Service”, the “Terms of Service” or the “Agreement”) govern membership in the Petite Studio Petite Club (the “Petite Club” or the “Program”). The Program is offered at the sole discretion of Petite Studio NYC LLC (“Petite Studio”, “Petite Studio NYC” or “we”). By participating in the Program, you (“you” or “Member”) acknowledge that you have read, understand, accept, and agree to be bound by this Agreement as well as the general Petite Studio Terms of Service and Privacy Policy (the “Petite Studio Terms of Service”). Capitalized terms used and not otherwise defined herein have the respective meanings ascribed to them in the Petite Studio Terms of Service. In the event of any inconsistency between the provisions of the Petite Studio Terms of Service and this Agreement, the terms and provisions of the Petite Studio Terms of Service shall govern and control.
The Program Generally. The Petite Club is one way in which Petite Studio NYC endeavors to reward and thank loyal customers for patronizing our business and purchasing Petite Studio NYC products. The Petite Club Members are eligible to earn and accumulate VIP credit by taking certain actions, which in turn, rewards the Members with exclusive perks.
Earning VIP Credit and Membership Generally. You may earn VIP credit based on the total dollars (USD) you have spent on orders placed after April 17, 2019. VIP credit is not awarded for third-party products, shipping fees or taxes. For your purchase to qualify to earn VIP credit, you must be signed into your Member account at the time of purchase; or provide your Program member identification (that is, the email address you registered under the Program) when making a qualifying purchase on www.petitestudionyc.com or at Petite Studio NYC Flagship Store. The VIP Program offers unique perks depending on the tier you are currently occupying. Once you earn VIP credit and reach a certain VIP tier, you will be eligible for certain rewards applicable to that tier. Such rewards are subject to change at any time and from time to time and may be offered on a limited, first come first served basis. You do not have to join the Petite Club to purchase products on our website or in any retail location. Membership in the Program is purely voluntary. The Program is available for the personal use of individuals only. It is not available to any business, group, or individual purchasing on behalf of other individuals. We reserve the right to cancel, modify or restrict any aspect of the Program at any time with or without notice. Membership in the Program may be revoked at any time. Membership is nontransferable. Any abuse of the Program, failure to follow any terms of the Program, or any misrepresentation may subject Members to revocation of Membership and will affect eligibility for further participation in the Program.
VIP Credit: VIP credit has no cash value and cannot be redeemed either in whole or in part for cash or anything else. The level of VIP credit required to reach each status level is determined by the Company in its sole discretion and may be changed without prior notice to you. VIP credit is non-negotiable. Rewards for each tier are not guaranteed and may change from time to time. VIP credit does not constitute property of any Member and may not be bought, sold or otherwise transferred. VIP credit cannot be shared. VIP credit is not awarded for returned items. If you return items from a qualifying purchase, the relevant amount of VIP credit will be deducted from your Account. VIP Status awards become official 6 weeks after purchase to allow for any returns to be processed. Your VIP discount code and VIP status perks can only be used after this 6 week period following a qualifying purchase. VIP tier status lasts for one year. Each year, your VIP status will be adjusted based on your spend over the previous twelve months.
Enrollment in the Program. Eligible individuals may enroll in the Program by visiting www.petitestudionyc.com and registering for the Program. You may be required to provide your personal information including full name, mailing address, email address, and telephone number. You will be prompted to create a password. After providing this information, you will be enrolled in the Program and provided a Member account. You are solely responsible for maintaining the accuracy of your account information and for updating it as required. Members must provide the required information to be enrolled and to be eligible for perks. Petite Studio NYC is not responsible for lost Rewards or communications due to an inaccuracy in or change of physical address, email address, phone number or any other contact information.
Other General Program Terms. VIP discount codes cannot be combined with any other coupon, discount code or promotion. If there is an ongoing sale promotion, the customer may choose to use the sale promotion or his/her VIP discount, but cannot use both together. We reserve the right to change the Program at any time and from time to time, include what perks are available, how a Member earns VIP credit, the level of each Program tier, and any other facet of the Program. We reserve the right to revoke VIP status or Program Membership, without notice, if we believe, in our sole discretion, that you are in violation of this Agreement. Petite Studio NYC reserves the right to exercise all rights and remedies at law or at equity, civil or criminal, in the event any Member abuses the program or violates any Terms of Service. This Agreement shall be governed by the laws of the State of New York. The failure of Petite Studio to enforce any provision of this Agreement shall not be construed as a waiver or limitation of Petite Studio’s right to subsequently enforce and compel strict compliance with every provision of this agreement.
Account and Program Termination: The Program may continue until such time as Petite Studio in its sole discretion elects to terminate the program. If Petite Studio elects to terminate the Program, Petite Studio NYC will notify you of its termination. Petite Studio reserves the right in its sole discretion to delete a Member’s account due to account inactivity without notice. No account credits, extensions, or other remuneration will be provided for VIP Credit that has been revoked from an Account based on inactivity. Petite Studio reserves the right to terminate an Account in which VIP credit was obtained as a result of any type of website or technical failure or fraudulent activity. All VIP credit will be lost if your Member account expires or is cancelled under any such circumstances.
Limitation of Liability: Neither Petite Studio nor any other party involved in creating, producing, or delivering the Program will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or goodwill, service interruption, computer damage or system failure or the cost of substitute services arising out of or in connection with these Terms of Service or from the use of or inability to use the services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not Petite Studio has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In no event will Petite Studio’s total liability arising out of or in connection with these Terms of Service or from the use of or inability to use the services or content exceed the amounts you have paid to Petite Studio for use of the services or content or one hundred dollars ($100), if you have not had any payment obligations to Petite Studio, as applicable. The exclusions and limitations of damages set forth above are fundamental elements of the basis of the bargain between Petite Studio and You.
